Terms of Service: Nairobi
1. Who we are and what this is
Escape the GrindLife ("GrindLife", "the game") is an online life game. These Terms cover the game set in Nairobi. In Nairobi it is run by PolicyMatch ("we", "us", "our"). These Terms of Service ("Terms") are a contract between you and us. They cover the Nairobi game on the web and in any app, our websites as you use them for Nairobi, and any related services (together, "the Service").
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy for Nairobi. If you do not agree, do not use the Service.
2. Who can play
GrindLife is meant for adults. Chat, dating, posting, payments and other features that involve other players need an account confirmed 18 or older. Under Kenyan law anyone under 18 is a child, and the game is not made for children. To use the Service, you must:
- be at least 18 years old;
- be able to enter into a binding contract under Kenyan law;
- not have been banned from the Service before; and
- not be barred from using the Service under the laws that apply to you.
Playing as a guest. You can play the single-player parts of the game without an account. A guest's life is saved only in their own browser. We do not keep a copy, so it is lost if that browser's storage is cleared (by you, by a private window closing, or by the browser itself: some browsers, Safari for one, clear a site's storage after about seven days without a visit). Make an account to keep it. Other players see a guest only as "Nairobian" with a short random tag. A guest never writes their own words to anyone and never reads other players' messages or posts: they can react, use the fixed quick replies and lines, sit at tables with other players, take gigs as the worker, play their own music files, and share a picture of their life card with a link to the game. A guest cannot message, post, date, send game money, publish, buy books, play music links, be on the leaderboards, or have a page of their own. Those need an account confirmed 18 or older. Anyone, guest or not, may read a book by a player that is free, and the opening pages (a sample) of one that is for sale, unless its author or a reviewer marked it 18+: an 18+ book needs a signed-in account confirmed 18 or older. Someone who signs in only to read and buy books (a "reader") gives an email address, a date of birth and accepts these Terms; they need not make a character until they want to play. Gig pay a guest earns is held for them in a guest wallet that can only receive it (never send it), up to a daily limit; it moves to their account when they make one, and if it is never claimed it ends 90 days after their last visit. These Terms apply to guests too. If you make an account later, the life you played as a guest moves to your account under the same rules as any other.
We ask for your date of birth when you make an account, and you confirm that you are 18 or older. That confirmation is a promise you make to us, and we rely on it. Giving a false date of birth breaks these Terms. If we learn that someone under 18 has an account, we will close it and delete its data.
If something suggests an account belongs to someone under 18 (for example, they say so in a message, or another player reports it), we ask them to confirm their age again. Until a person on our team or an age-verification provider clears the account, it cannot message people it does not mutually follow and cannot use dating.
If you give a false age, you are responsible for that, and to the extent the law allows, we are not liable for any loss or harm that results from it. You agree to cover any claims, costs or losses we face because you gave a false age (see section 16).
3. Your account
- One person, one account. Your account is for you alone. Do not share it, sell it, buy someone else's, or let anyone else use it.
- Your email is your key. You sign in with a link or code sent to your email address, so anyone who can read your email can sign in as you. Keep your email account secure, and tell us at once through our contact form if you think someone else has used your account.
- You are responsible for your account. You are responsible for what happens on it, unless it happened because of our own failure to protect it.
- Handles and names. Your @handle is unique to you. Handles and display names must follow the conduct rules in section 6. We may remove or change a handle or name that breaks those rules, that imitates someone else, or that infringes someone's rights. After an account is deleted, its handle stays unavailable for 30 days, then anyone can choose it.
- Accurate details. Keep your email address current so we can reach you about your account.
4. The game is a simulation
GrindLife uses real public sources for things like pay, rent, prices and taxes in Nairobi, so that what you learn in the game resembles the real world. But it is a game, and it simplifies.
- Nothing in the Service is financial, investment, tax, legal, medical, nursing or career advice. Do not rely on it to make real decisions. Talk to a qualified professional.
- Clinical situations in the game are simplified for play. They are not clinical guidance and must never be used to care for a real patient.
- The game shows real streets, estates, stages and places in Nairobi. That does not mean any hospital, school, business, matatu Sacco, county office, government body or person depicted is connected with us or endorses the game. Characters other than real players are fictional. The game's court, landlords, lenders and GrindPesa are part of the game, not the real ones.
5. Game money and virtual items
The game has its own money (for example, shillings in your character's bank account and in GrindPesa, the game's own mobile wallet), and things you can get with it, such as homes, cars, clothes, furniture, pets and businesses (together, "virtual items").
- Game money is not real money. It has no value outside the game. It is not your property, it is not a deposit, it is not e-money, and it does not earn real interest. GrindPesa is not M-Pesa and is not connected to M-Pesa or any real wallet.
- It is never redeemable. Game money and virtual items can never be exchanged, redeemed, cashed out or refunded for real money, airtime, data, vouchers, goods or services, by us or by anyone else.
- No real-money trading. You may not buy, sell, trade, rent or give away game money, virtual items, handles or accounts for real money or anything else of real value, inside or outside the Service. We may remove anything obtained this way and close the accounts involved.
- Challenges use game money only. When you challenge another player (for example, at drafti, kadi or pool) for game money, only game money changes hands. The Service is not gambling, takes no real money for any game, and offers no way to win anything of real value.
- A licence, not ownership. We give you a limited, personal, revocable, non-transferable licence to use game money and virtual items in the game, under these Terms. You do not own them.
- We may change the game. To keep the game fair and working, we may change, rebalance, reset or remove game money and virtual items, for example to fix a bug or undo an exploit. We will not owe you anything for doing so.
When we sell anything for real money, we show you the price and what you get before you pay. A purchase gives you a licence to use what you bought, and is final once delivered, except where these Terms or Kenyan law say otherwise (section 5A).
5A. Real-money purchases
In Nairobi, real money is used for the things below. Nothing else in the game can be bought with real money, and you never have to buy anything to keep playing.
- Billboards. A business can book days on the city's billboards and boards in the game, at grindlife.app/advertise. The price is shown in Kenya shillings before you pay. The business pays by M-Pesa: the payment prompt goes to the phone number given, and the payment is processed by Paystack. Bookings also follow our advertising terms.
- Books. Publishing a book and weeks on the front shelf are paid in Kenya shillings, by M-Pesa or by card, and the payment is processed by Paystack (section 7A).
- Copies of books by players. A reader can buy a copy of a book another player wrote, at the price its author set, in Kenya shillings, by M-Pesa or by card, processed by Paystack. Most of it is paid to the author (section 7A).
- Shop stalls. A verified seller can rent a pitch for a stall in a market hall in the game, for 7 or 30 days at a time, in Kenya shillings, by M-Pesa or by card, processed by Paystack (section 5C).
- Real money and game money never mix. What you pay in real money never turns into game money, GrindPesa or virtual items, and game money can never pay for anything sold in real money or be turned into it.
- Payment processor. Paystack handles the payment itself, and its terms apply to it. We never see your M-Pesa PIN or your card details.
- Before you pay. We show you who is selling (PolicyMatch), what you get, the total price and currency, how you pay, and these refund rules. You then choose to pay or not, and can fix any mistake before you confirm. These Terms stay at this address, so you can save or print them, and we send a receipt to the email given.
- When a purchase is final. What we sell is digital and starts as soon as it is delivered: a booked billboard day once it is live, a book fee once the book is published, a front-shelf week once it starts, a copy of a book once it opens in your Library. You cannot cancel it after that and there is no refund for changing your mind, except as the next two points say.
- When we refund. If we decline or take down a billboard booking before it runs, or a payment arrives after the days it was for are gone, we refund it in full automatically, to the M-Pesa number or card that paid. We also refund anything you paid for that we did not deliver. If something did not arrive, please tell us through our contact form, ideally within 30 days, so we can check it quickly.
- Your rights under Kenyan law. Nothing in these Terms takes away a right you have under the Consumer Protection Act, 2012 or any other Kenyan law that a contract cannot take away. For example, if we did not show you the information above before you paid, or did not let you accept or decline, that Act lets you cancel within seven days of receiving a copy of the agreement.
- Reversals. If a payment is reversed for any reason, what it paid for is taken back out of the game, and any agent's share on it is taken back (section 5B).
- Changes. We may change prices, or stop selling something, for the future. Something you already paid for and that was delivered stays delivered.
5B. Ad agents
Players can sell the city's billboards to real businesses as ad agents, from the Agent app on the game's phone, and earn a share of what those businesses pay, in real money. This is real work for real money, separate from the game.
- Who. An account confirmed 18 or older, not under an age check, who accepts the agent terms in the app. We approve each new agent, and we may decline anyone.
- What you earn. 20% of what a business pays for a booking you brought in (through your link, or booked by you for the business in the Agent app), and 20% of its renewals for 12 months after the first booking. The business must pay from its own M-Pesa number: no share is paid on a booking paid from your own payout number.
- When it is paid. Your share is held until the booking starts to run. Payouts go out once a week, on Monday from 10:00 Nairobi time, to your M-Pesa number, once you have Ksh 500 or more to collect. Payouts are sent through Paystack.
- Tax. We withhold tax from each payout and pay it to the Kenya Revenue Authority (KRA): 5% if you live in Kenya, 20% if you do not. Before your first payout you give us your KRA PIN and an M-Pesa number in your own name. You are responsible for any other tax on what you earn.
- Refunds come back. If a booking is refunded before your share is paid, the share is cancelled. If it is refunded after, the share is taken from your next payouts.
- Sell honestly. Real prices only, no promises we do not make, no pressure, no bookings for businesses that do not exist or did not agree, and no booking for yourself through someone else. Agents book at most 10 businesses a day. Section 6 applies to everything you do as an agent.
- Your relationship with us. As an agent you work for yourself. You are not our employee, partner or representative, and you may not sign anything or take payment on our behalf. Businesses always pay us directly, never you.
- Stopping. You can stop at any time. We may pause or end an agent who breaks these Terms, and we pay out what was properly earned, less anything taken back.
5C. Shop stalls
A shop stall lets a real trader show their real goods in the game: a pitch in a market hall, a name over it, photos, prices, a chat with buyers and links to where people can buy. It is a listing and nothing more.
- We only display listings. PolicyMatch shows what a seller lists. We do not sell, own, store, deliver, inspect or guarantee any goods, and we are not a party to any sale.
- Sales are between the buyer and the seller. Any order, delivery, return or complaint about goods is between the buyer and the seller, under Kenyan law, including the Consumer Protection Act, 2012. Links on a stall take you out of GrindLife to the seller (WhatsApp, a Facebook page, or their own website), and the game says so before you leave.
- Chatting with a seller. You can message a seller inside GrindLife. Section 6 and our message rules apply to every stall chat, both ways, and either side can report or block the other. Every stall chat shows the same reminder: never pay before you see the goods; GrindLife never handles payment. A seller may limit how many new chats they get, and we limit new chats to stop spam.
- We never handle goods or payments for goods. No payment for goods goes through GrindLife, ever. Pay the seller directly, the way you agree with them. Never send money to anyone who says they are paying or collecting on our behalf.
- Who can sell. An account confirmed 18 or older, at least 3 days old, that applies in the game with a trading name and a phone number. A person on our team checks every seller before anything shows, and we may decline anyone. A person on our team calls the phone number to check it is the seller's, or we send a code to it on WhatsApp where we offer that.
- What a stall may show. Only your own real goods or services, with honest photos and prices. Every photo and every word is checked by a person before it shows. Not allowed: drugs, prescription medicines, weapons, counterfeit or copied brands, adult content or services, betting or gambling, money schemes (pyramid or investment schemes, forex signals, quick loans), documents, IDs or accounts, wildlife products, shisha and illicit brews, stolen goods, and anything else that is illegal in Kenya or breaks section 6.
- Rent. A pitch is rented at Ksh 100 a day, paid in one go for 7 days (Ksh 700) or 30 days (Ksh 3,000), at the price shown before you pay. Featured pitches, by the entrance of a hall, cost twice as much; featured stalls are marked as featured and take turns at the top of the list. Rent is paid in Kenya shillings through Paystack and is not a lease of any real place. Days you buy add on to any you have left. When they run out, the stall closes and the pitch is free for someone else. Rent paid by the month before 19 October 2026 keeps every day it paid for.
- Refunds. If a payment for a pitch arrives after someone else has taken it, we refund it in full automatically. Rent is not refunded because a listing waits for review or is declined: you can change it and send it again. If we take a stall down because it breaks these Terms, the rent is not refunded. If we close stalls for our own reasons, we refund the unused days.
- Giveaways at stalls. A seller can put up game money from their own game wallet for players who come to their market hall. Entering is free and prizes are game money only, never real money. The server draws the winners; a second account of the seller and recent winners from the same seller cannot win.
- Reports. Any player can report a stall. A report goes to a person on our team. A stall is paused for review only when several different players report it, and a person decides what happens next. You can tell us your side through our contact form.
- Your details. We keep a seller's phone number sealed and use it only to check the seller, to contact them about their stall, and where the law requires. The Privacy Policy says more.
6. How to behave
GrindLife is a shared world for adults. Other players are real people. Treat them with respect, and leave people alone when they do not want to talk to you. When you use the Service, you agree not to:
- Harass or threaten anyone. No threats of violence, stalking, sustained bullying, telling someone to hurt themselves, hate speech, or attacks on people for their tribe, ethnicity, race, national origin, religion, sex, gender identity, sexual orientation, disability, age or any similar trait.
- Post sexual content involving minors. Any sexual content involving anyone under 18, real or fictional, and any sexual talk with someone who says they are under 18, is banned. We remove it, lock the accounts involved, and report it to law enforcement and to the bodies that receive reports of child sexual abuse material.
- Pressure anyone sexually. No sex without consent, no threatening to share someone's pictures (sextortion), no coercion, and no sharing intimate images of anyone without their consent.
- Support terrorism or violent extremism. No praising, recruiting for or planning attacks, or cheering on terrorist or violent extremist groups. Talking about the news is fine.
- Post sexually explicit content in any public part of the game, or send it to anyone who has not asked for it.
- Pretend to be someone else. No impersonating another player, a real person, a celebrity, a business, a hospital, a government body, or us or our staff.
- Offer or arrange anything illegal. No selling, buying or arranging drugs, guns or other weapons, stolen goods, fake documents or any other illegal goods or services. No encouraging self-harm or violence.
- Buy or sell sex for real money, advertise escort services, or take part in trafficking anyone.
- Share other people's private information, such as their real name, address, phone number, ID number, workplace, school or photos, without their permission.
- Trade for real money, as described in section 5.
- Spam, scam or advertise. No phishing, pyramid schemes, chamas or "investments" that are really scams, fake M-Pesa messages, or links that try to get players' details or money. Don't ask people you don't know for real money, airtime, vouchers, crypto, or payments by M-Pesa, Airtel Money or bank transfer. Game money between players is fine.
- Cheat or break the Service. No bots, scripts, or modified clients; no exploiting bugs instead of reporting them; no scraping; no getting around rate limits, bans or blocks; no attacks on our servers; and no attempts to reach accounts or data that are not yours.
- Break the law or infringe anyone's intellectual property, privacy or other rights.
7. What you post
Some parts of the game let you share things with other players, such as posts, replies, your handle, your display name and your character ("your content"). Today most of what you can post is chosen from lists we write. We may add free text, pictures or other ways to share later, and these Terms will apply to them.
- You keep any rights you have in your content.
- You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, show, adapt (for example, to fit a screen) and share your content, only as needed to run, show and improve the Service. This licence ends when your content is deleted, except for copies we must keep by law or in backups for a short time, as our Privacy Policy explains.
- You are responsible for your content, and you promise you have the right to share it.
- We do not check everything before it appears, but we may review, hide or remove any content at any time, for any reason that is consistent with these Terms.
7A. Books you write
You can write books in the game's Library app, share a draft with friends by link, and publish a book so other players can find, buy and read it.
- It stays yours. You keep the copyright in your book. Publishing does not transfer it to us.
- What you let us do. When you publish, you give us a worldwide, non-exclusive, royalty-free licence to host, copy, show and distribute your book in the game and on grindlife.app, including its own page with the opening pages, its cover and share picture, and posts about it in the game. This lets us run the Library and point people to your book. It ends when you delete the book or your account. If you only take it off the shelf, players who already have a copy can keep reading it. We may keep copies the law or our records require. A draft you share by link is shown only to people with the link.
- Who can read. Anyone may read a free book and the opening pages of a book for sale (a sample), without an account, unless it is marked 18+. You must mark your book 18+ if it is meant for adults (for example, sex or strong violence); a reviewer may mark it too. An 18+ book opens only for signed-in accounts confirmed 18 or older. Adult themes are allowed with the label. Sexual content involving anyone under 18 is never allowed, labelled or not: we remove it, lock the account and report it (section 6).
- Your promise. You promise you wrote the book or have every right to publish it, that it does not copy anyone else's work without permission, and that it follows section 6. Books may not contain sexual content involving anyone under 18, hate or harassment, other people's private details, spam or ads, or real instructions for causing serious harm.
- We read it first. We review every book, and every change to a published book, before it goes on the shelf. Paying does not skip the review or guarantee that a book is published. We may decline a book, or take one down later, if it breaks these Terms or the law. We tell you what to change.
- Fees. Publishing costs Ksh 250 once per book. A week on the front shelf costs Ksh 500. Both are paid in Kenya shillings, by M-Pesa (a prompt to the phone number you give) or by card, and processed by Paystack. If we do not publish your book, we refund the publishing fee and any front-shelf weeks in full, automatically. If we take a published book down before a front-shelf week starts, we refund that week. Otherwise fees are not refundable, except where Kenyan law says they must be (section 5A).
- Selling copies. You set the price readers pay for a copy: free, or from Ksh 20 to Ksh 2,000 in whole shillings. Readers pay in Kenya shillings, by M-Pesa or by card, processed by Paystack. You get 70% of the price. We keep 30%, and the payment company's fees come out of our 30%, never out of yours. You can change the price; a copy already bought keeps the price paid.
- When you are paid. Your share of each sale is held for 7 days, in case the reader is refunded, and then becomes payable. Payouts go out once a week, on Monday from 10:00 Nairobi time, to an M-Pesa number in your own name, once you have Ksh 500 or more to collect, sent through Paystack. Before your first payout you give us your KRA PIN and that number.
- Tax on what you earn. We withhold tax from each payout and pay it to the Kenya Revenue Authority (KRA): 5% if you live in Kenya, 20% if you do not, as the Income Tax Act sets for royalties and digital content. You are responsible for any other tax on what you earn.
- Refunds and holds. If a reader is refunded (for example, the copy did not open, the payment was taken twice, or the book was taken down for copying someone else's work), the copy is withdrawn and your share is cancelled, or taken from your next payouts if it was already paid. We may hold your payouts while we look into a copyright complaint, a report, or a payment that looks wrong, and we tell you why.
- A reader's copy. A copy is a personal licence to read the book inside GrindLife on your account. It cannot be downloaded, copied, shared, resold or given to someone else. Each copy shows the reader's handle on its pages. One copy per reader; you cannot buy your own book.
- No game money for real copies. A book priced in shillings can only be bought with real money, and what an author earns is real money, never game money. Books by authors in cities that sell for game money are bought with game money as before (section 5).
- Taking a book down. You can take your book off the shelf at any time; readers who bought it keep their copy. We may take a book down under this section, and if we take it down because it copied someone else's work or broke the law, we refund its readers.
- If someone copied your work. Follow our Copyright Policy (or use our contact form with the subject "Copyright"): which book, what it copies, how we can reach you, and a statement that you believe in good faith the use is not allowed and that what you say is accurate. We will take the book down while we look and let its author respond.
7A-2. Music you play or share
At a party, a club or a listening party, the room can play one shared queue of music. You can add a YouTube or SoundCloud link (it plays through that service's own player; we do not copy it), pick a track from our house playlist, or, if you host, play songs from your own device live to the room (streamed while you play; we do not upload or keep it).
- Only play or share music you have the rights to share. That covers links, drops at a listening party and anything you play live.
- Anyone can report a track, and we review every report. Several reports from different players in a short time, or a formal notice, pause the host's live music while we look. Rights holders can send a notice under our Copyright Policy or through our contact form.
- Players who keep sharing music they have no right to lose the ability to play to rooms, and may lose their account.
7B. Messages and invites
- Messages are between adults. You can message other players one to one or in groups. Section 6 applies to every message. Someone who does not follow you gets your first message as a request, and can decline it.
- Some messages are not sent. Before a message goes out, it is checked automatically against section 6. Threats, slurs, sales of drugs or weapons, payment asks to strangers, phone numbers, emails, home addresses and ID numbers are not sent. Sexual content involving anyone under 18 is not sent, the account is locked and it is reported to us at once.
- A second look. Messages the first check is unsure about, every report, and a small random share of messages between people who do not both follow each other are reviewed automatically, with a few messages around them. Nobody at GrindLife reads a randomly checked message unless that review finds a problem.
- Reports. If you report a message, it is reviewed with the messages around it, by our automatic review and, where needed, by a person on our team.
- Deals and the game's court. Deals you make with other players (a venue's cut, a lawyer's fee) are recorded, and the game does not pay them for you. If you file a claim, or one is filed against you, the game's court reviews the deal, what was paid, and your messages with the other player about it. Only the chat between the two of you, never your other chats. A court order is game money only (section 5). Leave one unpaid past its date and the court takes it from your account in the game, and from your pay if that is short, and pauses your deals and paid events for 7 days.
- Invites. If a friend signs up through your link and plays a little, you may both get a game-money bonus. It is game money only (section 5). One bonus per new player, with daily limits. Bonuses from fake or duplicate accounts are refused, and we may take back bonuses that broke these rules.
7C. Dating
- Off until you turn it on. Dating other players is opt-in, and turning it on asks you to confirm your age again. Only the people your settings allow can ask you out. If an account may belong to someone under 18, its dating is paused until we check.
- Both say yes, every step. An ask, going exclusive, a date and every hug, dance or kiss in the game needs the other person's yes at that moment. Either of you can end it at any time, without the other's say. Nothing sexual is ever shown in the game.
- No means no. A no locks that ask for 30 days and a second no is final. Asking again and again, pressure, and moving someone off the game against their wishes break section 6. You can report or block from every card, chat and profile. A block is final: they can never contact you again.
- Never real money. Do not ask anyone for real money, airtime, vouchers, M-Pesa or crypto. Until two people have dated for three days, dating chats do not send phone numbers, links or payment apps. A confirmed money ask is a ban.
- Game money only. Dates are paid in game money from your wallet (section 5). A dating relationship in the game has no legal effect and nothing here is advice about real relationships.
8. Reporting, blocking and enforcement
- Report and block. You can report a player, a post or a message, and block a player so you no longer see them. You can also write to us through our contact form.
- What we do. We review reports and may remove content, give warnings, limit features, suspend an account or close it. Serious cases, including any sexual content involving minors and credible threats of violence, may be reported to law enforcement.
- Automatic moderation. We use automated checks to enforce these Terms. On their own they can take a message down, send you a warning (in the game and by email), pause your messaging for a few hours, suspend your account for up to 24 hours, or ask you to confirm your age. Repeat breaks lead to stronger steps. For sexual content involving minors, credible threats of violence and terrorism, an account is locked at once until a person on our team reviews it. Every automatic action is logged and can be reversed.
- People decide the big things. Only a person at GrindLife can close an account for good or ban it.
- If you are struggling. Talking about self-harm never gets you in trouble. We may show you support resources, such as free helplines in Kenya.
- Appeals. If you think we got it wrong, write to us through our contact form from the email on your account within 30 days. A person will look again and tell you what we decided.
9. Our content and your licence to play
The Service, including the game, its code, art, text, music, characters, data compilations and our names and logos, belongs to us or to the people who licensed it to us. Some parts are used under open licences, which are credited in the game.
We give you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for your own non-commercial entertainment, under these Terms. You may not copy, sell, rent, sublicense or make derivative works of the Service, or reverse engineer it except where the law allows that despite this restriction. Streaming and sharing videos or screenshots of your play is welcome, as long as you follow section 6. Working as an ad agent under section 5B is allowed.
10. Feedback
If you send us ideas or suggestions, we may use them freely without paying you or crediting you.
11. Changes to the Service
The game is being built and will change. We may add, change or remove features, careers, places and content, and we may stop offering the Service. If we plan to shut down the Service, we will try to give at least 30 days' notice in the game or by email, and we will pay agents what they properly earned.
12. Changes to these Terms
We may update these Terms. If a change matters, we will tell you in the game or by email, and ask you to accept the new Terms before you keep playing. The date and version at the top show when they last changed. If you do not agree to new Terms, stop using the Service and delete your account.
13. Ending your account
- You can delete your account at any time from the game (Account, then Delete my account). This deletes your account and your saved game straight away, as our Privacy Policy explains, and cannot be undone. If you are an agent, the records of what you earned, were paid and had withheld are kept as Kenyan tax law requires.
- We may suspend or close your account if you break these Terms, if the law requires it, if your account puts other players or the Service at risk, or if we stop offering the Service. Where it is reasonable and safe, we will tell you why.
- When an account is closed, its licence to use the Service, game money and virtual items ends. Sections 5, 5A, 5B (for shares already earned or taken back), 7 (for content already shared), 9, 10, and 14 to 18 continue to apply.
14. Disclaimers
The Service is provided "as is" and "as available". Apart from the promises the law makes for us and does not let us exclude, we make no other promises or warranties, express or implied. In particular, we do not promise that the Service will be uninterrupted, secure or free of errors, that saves will never be lost, or that any information in the game is accurate or complete.
The promises the law makes for us stay in place. Under the Consumer Protection Act, 2012, what you pay us for must be of reasonably merchantable quality, and nothing in these Terms changes that. We are not responsible for what other players do or say, inside or outside the Service.
15. Limits on our liability
We will not be liable for indirect or consequential loss (loss that does not follow naturally from what we did, but depends on your own circumstances that we did not know about), or for lost profits, goodwill, game money or virtual items, arising out of or relating to the Service or these Terms. Our total liability to you for all claims relating to the Service or these Terms is limited to the greater of the amount you paid us in the 12 months before the claim arose, or ten thousand Kenya shillings (Ksh 10,000).
These limits do not apply to:
- death or personal injury caused by our negligence;
- fraud, or anything we did on purpose to cause you harm;
- a refund, remedy or compensation that a Kenyan law gives you and does not let a contract take away, including under the Consumer Protection Act, 2012 and the Data Protection Act, 2019 (for example, compensation for damage caused by our breach of that Act); or
- an agent's earned shares under section 5B.
If a court decides that any part of this section cannot apply, the rest of it still applies as far as the law allows.
16. Your responsibility to us
If someone brings a claim against us because of your content, because you gave a false age, because of what you did as an agent, or because you broke these Terms or the law, you agree to cover our reasonable costs of dealing with it, including reasonable legal fees, to the extent the law allows.
17. Disputes and governing law
These Terms are governed by the laws of Kenya. Any dispute about the Service or these Terms will be heard in the courts of Kenya, and you and we both agree to those courts. A claim of up to one million Kenya shillings (Ksh 1,000,000) can go to the Small Claims Court, which is quicker and cheaper for both of us. If you live outside Kenya in a country whose laws give you the right to bring a claim in your own courts, nothing here takes that right away.
Before going to court, please write to us through our contact form and give us 30 days to try to sort it out. Most problems can be fixed that way. Once a dispute has arisen, you and we can also agree to settle it by mediation or arbitration instead, but neither of us has to.
18. The rest
- These Terms, together with the Privacy Policy for Nairobi, the advertising terms for bookings, and any rules we show you in the game, are the whole agreement between you and us about the Service.
- If any part of these Terms cannot be enforced, the rest still applies.
- If we do not enforce a part of these Terms right away, we can still enforce it later.
- You may not transfer your rights under these Terms. We may transfer ours, for example if the game is sold, and we will tell you if that happens.
- We are not responsible for delays or failures caused by events outside our reasonable control, including M-Pesa or payment processor outages.
- We may send you notices by email or in the game. You may send notices through the contact details below.
